Terms of Service

These Terms of Service ("Terms") govern your use of sweepsluxe.com and the services SweepsLuxe, Inc. ("SweepsLuxe", "we", "us") provides there, including entering sweepstakes and using a partner portal. By creating an account or using the site, you agree to these Terms. If you do not agree, do not use SweepsLuxe.

Eligibility

You must be at least 18 years old, or the age of majority where you live if that is higher, to create an account. Each sweepstakes sets its own eligibility requirements, including where entrants must live, in its Official Rules.

Your account

• Give accurate information and keep it up to date. A prize can only be awarded to an eligible person whose details can be verified.
• One account per person. Creating several accounts to gain extra entries is not allowed.
• You are responsible for activity on your account and for keeping your sign-in details secure. Tell us promptly if you believe your account has been used without your permission.
• You can delete your account at any time from your profile page.

Sweepstakes

• Every sweepstakes on SweepsLuxe has its own Official Rules, linked from its page. They govern that sweepstakes, and if they conflict with these Terms, the Official Rules prevail for that sweepstakes.
• No purchase or payment is necessary to enter or win, and a purchase does not improve your chances. The Official Rules of each sweepstakes describe a free alternative method of entry.
• Entries and tickets have no cash value, cannot be transferred, sold or exchanged, and exist only to take part in the drawing they belong to.
• Entries made with automated tools, scripts or bots, through multiple accounts, or otherwise in breach of the Official Rules or these Terms are void, and we may disqualify the person responsible.
• Features such as daily check-ins, tasks, streaks and referrals may be changed or withdrawn; entries already earned are handled as the Official Rules of each sweepstakes say.

Resorts, brands and their offers

Sweepstakes on SweepsLuxe are hosted with resorts and brand sponsors. Their offers, perks, websites and bookings are theirs: their own terms apply to them, and we are not responsible for third-party websites or for goods and services a third party provides. Resorts and brands that use a SweepsLuxe partner portal may also be bound by a separate agreement with us, which prevails for their use of the portal.

Emails

We send emails you need about your account and the sweepstakes you enter. We may also send you news about other sweepstakes and offers; every such email has an unsubscribe link. How we handle your information is described in our Privacy Policy.

Acceptable use

Do not use SweepsLuxe to break the law, to interfere with the site or other users, to access it by automated means such as scraping or bots, to probe or bypass its security, to impersonate anyone, or to submit content that is unlawful, misleading or infringes someone else's rights.

Content you submit

You keep ownership of what you submit — form answers, uploads and similar content. You give us permission to use it to operate SweepsLuxe and the sweepstakes you take part in, including sharing it as our Privacy Policy describes. You confirm you have the right to submit it.

Our content

The site, its design, text, graphics and software belong to SweepsLuxe or its licensors. Resort and brand names, logos and images belong to their owners. You may use the site for your own personal, non-commercial purposes, and not otherwise copy or reuse its content without permission.

Suspension and termination

We may suspend or close an account, or void its entries, if it breaks these Terms or the Official Rules, or to protect the fairness of a sweepstakes or the security of the site. You may stop using SweepsLuxe and delete your account at any time.

Disclaimers

SweepsLuxe is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement, and we do not promise that the site will be uninterrupted or error-free.

Limitation of liability

To the fullest extent the law allows, SweepsLuxe is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or data, arising from your use of the site. Our total liability for any claim relating to the site is limited to one hundred U.S. dollars (US$100). Some jurisdictions do not allow these limitations, so they may not all apply to you. Liability relating to prizes is governed by the Official Rules of the sweepstakes concerned.

Indemnity

You agree to indemnify SweepsLuxe against claims and costs arising from your breach of these Terms or your misuse of the site.

Governing law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Lee County, Florida, unless the law where you live requires otherwise.

Changes to these Terms

We may update these Terms. The date at the top shows when they last changed, and we will tell you by email or on the site before a material change takes effect. Continuing to use SweepsLuxe after that means you accept the updated Terms.
